Mr. Fremont McNeal proposes to discharge approximately 480 cubic yards of <br />fill material in a wetland adjacent to Oak Lake as part of a project to build <br />an access road. The project site is located in the SW -4 SWI -4 sec. 20, T. 40N., <br />R. 14W., Burnett County, Wisconsin. The road is needed to reach three lakeshore <br />lots located north of the wetland. Before the fill was discharged, the existing <br />muck would be dredged down to the stable bottom soil. The dredged material <br />would be discharged on upland sites nearby. The excavated area would then be <br />filled with clean sand to provide a roadbed measuring 80 feet long by 20 feet <br />wide by 5 feet thick. The sand fill would then be covered by a layer of gravel. <br />2. The above activity requires an individual Department of the Army permit <br />under Section 404 of the Clean Water Act. Therefore, our public interest <br />review will consider the guidelines set forth under Section 404(b) of the Clean <br />Water Act (40 CFR 230). <br />3. The attached drawings and information below were submitted by the applicant <br />and form the basis of our preliminary evaluation. <br />APPLICANT'S ADDRESS: Route 1 <br />Webster, Wisconsin 54893 <br />PHONE NUMBER: (715) 866-4431 <br />JURISDICTION: Oak Lake and its adjacent wetlands come under the regulatory <br />jurisdiction of the Corps of Engineers because the degradation or destruction <br />of the lake could affect interstate commerce. <br />VEGETATION IN AREA TO BE FILLED: The wetland through which the road would <br />pass is a bog marsh. <br />SOURCE OF FILL MATERIAL: A hill south of the bog. <br />SURROUNDING LAND USES: Residential. <br />QUANTITY AND TYPE OF MATERIAL TO BE DREDGED OR EXCAVATED: Approximately <br />300 cubic yards of muck. <br />METHOD OF DREDGING OR EXCAVATION: A backhoe and dragline. <br />ENDANGERED OR THREATENED WILDLIFE OR PLANTS OR THEIR CRITICAL HABITAT: <br />None were listed by the applicant or are known to exist in the permit area. <br />However, Burnett County is within the known or historic range of the following <br />threatened species: <br />Species Habitat <br />Bald Eagle Breeding <br />NCS Form 61 <br />15 Mar 82 <br />
