VARIANCE AGREEMENT <br />WHEREAS, Brett A. Johnson (hereinafter "Johnson") is the owner of that certain <br />property located at 7589 Round Lake Drive, Town of Swiss, County of Burnett, State of <br />Wisconsin, PIN 07-032-2-41-16-33-5 05-003-022000, Alternate/Legacy ID 032-5333-05 700 <br />(hereinafter "Subject Property") and legally described as follows, to -wit: <br />Lot 1, Burnett County Certified Survey Map No. 4649, Volume 25, <br />pages 328-330; and <br />WHEREAS, Johnson wants to install a septic/sewage treatment system on the Subject <br />Property, and needs a variance from the setback requirement in relation to the roadway, i.e. <br />Round Lake Drive for this purpose; and <br />WHEREAS, the roadway is maintained by the Town of Swiss and/or Burnett County, <br />and for purposes of the variance it is required that Johnson not hold the Town of Swiss and/or <br />Burnett County liable or responsible for damage which may be caused to the septic/sewage <br />treatment system by plowing or other normal maintenance of the roadway. <br />NOW, THEREFORE, in consideration of the variance to allow the installation of the <br />septic/sewage treatment system on the Subject Property, Johnson hereby agrees not to hold the <br />Town of Swiss and/or Burnett County liable or responsible for any damage to the septic/sewage <br />treatment system caused by plowing or other normal maintenance of the roadway. <br />This Variance Agreement is conditioned upon Johnson's receipt of the variance, shall run <br />with the Subject Property, and is binding on all subsequent owners of the Subject Property, the <br />heirs, successors, and assigns of Johnson. <br />Dated: j % P/ , 2016. <br />s <br />Subscribed and sworn to before me Bre A. <br />this IL41= day of July, 2016. <br />IL <br />JAN M.
