BURNETT COUNTY ZONING ADMINISTRATION <br />BURNETT COUNTY GOVERNMENT CENTER <br />7410 COUNTY ROAD K, #102 PHONE (715) 349-2138 <br />SIREN, WISCONSIN 54872 <br />November 9, 2010 <br />Michael Taylor <br />5926 Highway 70 <br />Webster, W154893 <br />RE: Grading Violation at David Hover property at 25038 Clam Shell Lane. <br />Dear Mike; <br />Enclosed you will find the citation for grading and filling nominally 10,000 <br />square feet of area within 300 feet of the Ordinary High Water Mark of Lower <br />Clam Lake without the required Land Use Permit on the David Hover property at <br />25038 Clam Shell Lane, per our phone conversation of last week. As we <br />discussed, the disturbed area was large enough to potentially fall under the <br />jurisdiction of the Wisconsin Department of Natural Resources under Section 30, <br />Stats, but inasmuch as the project could have received a permit under either <br />County or State jurisdiction, it was decided to defer enforcement and permitting <br />to the County. We will also require an" after the fact" Land Use Permit for <br />grading more than 2000 square feet of area from the property owner, which <br />requires a double fee assessment of $200.00. <br />We appreciate your efforts to stabilize the site to prevent erosion prior to the <br />significant rain fall event that subsequently occurred; clearly the erosion control <br />measures being in place were a positive influence in the Water Management <br />Specialist's decision to defer enforcement to the County. <br />Sincerely, � <br />Craig onroy� <br />Assistant Zoning Administrator <br />
