SUBDIVISION ORDINANCE <br />Article One: Preamble <br />1.1 Title <br />This Ordinance shall be known as the Burnett County Subdivision Control Ordinance. (Hereinafter, <br />"Ordinance") <br />1.2 Intent and Purpose <br />This Ordinance is intended to regulate and control the division and subdivision of land within the <br />unincorporated areas of Burnett County in order to promote the public health, safety and general welfare <br />and encourage the most orderly development of land while preserving existing resources. This Ordinance <br />is also intended to achieve the purposes listed in s. 236, Wis. Stats. and the Burnett County Land Use <br />Ordinance. <br />1.3 Statutory Authority <br />These regulations are adopted under the authority granted by s. 59.69, s. 59.692, s. 236 and s. 703.27(1), <br />Wis. Stats. <br />1.4 Jurisdiction <br />The jurisdiction of this Ordinance shall include all unincorporated lands within Burnett County, exclusive <br />of those lands held in public trust by the Federal Government. <br />1.5 Definitions <br />(A) Applicant: Any person or persons, firm or corporation, or any agent thereof, dividing or <br />proposing to divide land as defined by the terms of this Ordinance. <br />(B) Certified Survey Map: A survey of lot or lots that meet the requirements of s. 236, Wis. Stats. <br />(C) Common Open Space: Undeveloped land within a Planned Residential Development that has <br />been designated, dedicated, reserved or restricted in perpetuity from further development, and is <br />set aside in the interest of the residents of the development. Common open space shall not be part <br />of individual residential lots. It shall be substantially free of structures, but may contain historic <br />structures and archaeological sites including Indian mounds, and/or such recreational facilities for <br />residents as indicated on the approved development plan. <br />(D) Condominium: A community association combining individual unit ownership with shared use <br />or ownership of common property or facilities, established in accordance with the requirements of <br />the Condominium Ownership Act, s. 703, Wis. Stats. A condominium is a legal form of <br />ownership of real estate and is not a specific building type or style. <br />(E) Conservation Easement: The grant of a property right or interest from the property owner to a <br />unit of government or nonprofit conservation organization stipulating that the described land shall <br />remain in its natural, scenic, open or wooded state, precluding future or additional development. <br />(F) Contiguous: Touching at a point or along a boundary. <br />(G) Cul-de-sac: A road having one end open to traffic and the other permanently terminated by a <br />vehicular turnaround. <br />
