2.2 Subdivisions Not Requiring Surveys <br />(A) Parcels with a nominal ten (10) acres or greater may be created as long as the parcels have at least <br />a nominal three hundred thirty (330) feet of width, do not create conflict with surrounding legal <br />descriptions as determined by the Land Information Department, and meet zoning district lot <br />standards. The following statement shall be included on the deed, land contract, or other <br />document of ownership transfer or as an attachment to the document: <br />"The legal description contained within this document represents a change of the legal <br />description contained within document number recorded in <br />Volume , Page , of the Office of the Register of Deeds and is creating, <br />modifying, re -dividing, or redefining a parcel of land." <br />(B) The sale or exchange of parcels between owners of adjoining property is permitted if additional <br />lots are not thereby created and the resulting lots are not reduced below the minimum size <br />required by Burnett County Land Use Ordinance or other applicable laws or ordinance. <br />Documentation may be required on parcels with improvements by either certified survey map, <br />map of survey, or plat. The following statement shall be included on the deed, land contract, or <br />other document of ownership transfer or as an attachment to the document: <br />"The above described parcel is adjoining to and intended to be considered as a single parcel <br />with the parcel described in Document Number Volume <br />Page which is not to be conveyed or used as an independent parcel." <br />2.3 Subdivisions Reguirine A Survey <br />(A) All parcels created with less than forty (40) acres (except those created per Section 2.2 (A and B) <br />above) shall require a survey by a Wisconsin Registered Land Surveyor. <br />(B) Prior to the final approval of land divisions requiring a survey, the owner of the land shall have <br />the parcels surveyed by a Wisconsin Registered Land Surveyor. The surveyor shall create a <br />certified survey map or plat, in the manner prescribed in Chapter 236 of the Wisconsin Statutes; <br />unless exempt under the provisions of Section 6.3 of this Ordinance or unless waived in writing <br />by the Land Use and Information Committee. <br />(C) Certified survey maps may be prepared and recorded for land divisions resulting in the creation of <br />up to eight parcels of less than ten (10) acres each, with no more than four (4) parcels of 1.5 acres <br />or less, within a period of five (5) years. <br />(D) County, municipal or town plats shall be prepared and recorded for all land divisions resulting in <br />the creation of more than eight (8) parcels, with no more than four (4) parcels of 1.5 acres or less, <br />within a period of five (5) years (except those created per Section 2.2). <br />(E) Subdivisions created under s. 236, Wis. Stats. shall be subject to all applicable provisions of this <br />Ordinance. <br />2.4 Recording Requirements <br />(A) All certified survey maps and subdivision plats shall be recorded in the office of the Burnett <br />County Register of Deeds, in the manner described in s.59.51 and s. 236 Wis. Stars. This <br />recording shall be within six (6) months of the final approval and twenty-four (24) months of the <br />first approval of the certified survey map or the subdivision plat by the Burnett County Land Use <br />and Information Committee or Land Use/Zoning Department. <br />2 <br />
