To regulate the division of land within the unincorporated areas of <br />Burnett County for the purposes listed in Chapter 236 of the Wisconsin <br />Statutes and to provide safe and orderly shoreland subdivision layouts <br />pursuant to Sections 59.971 (3), 144.26 (2), 144.26 (8) and 236.45, the <br />Board of Supervisors of Burnett County ordains Subdivision <br />Regulations as follows: <br />a <br />SECTION 1: GENERAL INTERPRETATION <br />This ordinance shall not repeal, impair or modify private <br />easements or covenants governing the use of lands except that it shall <br />be applicable to the extent that it imposes stricter regulations. <br />SECTION 11: GENERAL REQUIREMENTS <br />The County Planning Agency or its duly appointed staff, in <br />considering an application for the subdivision of land, shall be guided <br />by the following considerations and standards. <br />A. The County Planning Agency or its duly authorized staff shall <br />be res-,nnsible for administration of this ordinance. <br />B. Subdivision includes any division of a parcel of land by the <br />owner or his agent for the purpose of sale or building development, <br />where: <br />1. The act of division creates five or more parcels of 1'/2 acres or <br />less each. <br />2. Five or more parcels of 11/2 acres or less each created by <br />successive divisions within a five-year period. <br />C. This ordinance shall not apply to divisions exempt from platting <br />controls under the provisions of Section 236.03 and 236.45 (2) <br />Wisconsin Statutes. <br />D. Every Division of land within the unincorporated areas of <br />Burnett County shall be subject to the provisions of this ordinance and <br />Chapter 236 of the Wisconsin Statutes. <br />E. All lots adjoining any navigable lake or stream shall have a <br />minimum water frontage of 100 feet, a minimum distance between <br />parallel lines of 97 feet and shall meet the minimum requirements of <br />Wisconsin Administrative Code H65.03 (lot area) and H65.05 <br />(elevation). All other lots shall comply with the minimum requirements <br />of Wisconsin Administrative Code H65.03 (lot area), H65.04 (lot length <br />& width) and H65.05 (elevation). <br />F. A subdivision permit and a certified survey shall be required <br />when any property of a single legal description is divided and a parcel <br />(s) of less than 5 acres in size result. <br />G. All divisions of land subject to this ordinance shall also be in <br />conformity with the county zoning ordinance, county sanitary code and <br />any official map ordinances in effect in the county. <br />H. Before the final plat is approved by the County Planning <br />Agency, the subdivider shall install all improvements required by this <br />ordinance, or by town or municipal units of government, or shall file a <br />performance bond with the county clerk (or meeting the approval of the <br />District Attorney) insuring installation of such improvements. <br />
