To regulate the division of land within the unincorporated areas of Burnett County for the purposes listed in Chapter 236 of the Wisconsin Statutes and to provide safe and orderly shoreland subdivision layouts pursuant to Sections 59.971 (3), 144.26 (2), 144.26 (8) and 236.45, the Board of Supervisors of Burnett County ordains Subdivision Regulations as follows: a SECTION 1: GENERAL INTERPRETATION This ordinance shall not repeal, impair or modify private easements or covenants governing the use of lands except that it shall be applicable to the extent that it imposes stricter regulations. SECTION 11: GENERAL REQUIREMENTS The County Planning Agency or its duly appointed staff, in considering an application for the subdivision of land, shall be guided by the following considerations and standards. A. The County Planning Agency or its duly authorized staff shall be res-,nnsible for administration of this ordinance. B. Subdivision includes any division of a parcel of land by the owner or his agent for the purpose of sale or building development, where: 1. The act of division creates five or more parcels of 1'/2 acres or less each. 2. Five or more parcels of 11/2 acres or less each created by successive divisions within a five-year period. C. This ordinance shall not apply to divisions exempt from platting controls under the provisions of Section 236.03 and 236.45 (2) Wisconsin Statutes. D. Every Division of land within the unincorporated areas of Burnett County shall be subject to the provisions of this ordinance and Chapter 236 of the Wisconsin Statutes. E. All lots adjoining any navigable lake or stream shall have a minimum water frontage of 100 feet, a minimum distance between parallel lines of 97 feet and shall meet the minimum requirements of Wisconsin Administrative Code H65.03 (lot area) and H65.05 (elevation). All other lots shall comply with the minimum requirements of Wisconsin Administrative Code H65.03 (lot area), H65.04 (lot length & width) and H65.05 (elevation). F. A subdivision permit and a certified survey shall be required when any property of a single legal description is divided and a parcel (s) of less than 5 acres in size result. G. All divisions of land subject to this ordinance shall also be in conformity with the county zoning ordinance, county sanitary code and any official map ordinances in effect in the county. H. Before the final plat is approved by the County Planning Agency, the subdivider shall install all improvements required by this ordinance, or by town or municipal units of government, or shall file a performance bond with the county clerk (or meeting the approval of the District Attorney) insuring installation of such improvements.
