Developer's commitment to subdivide according to a certain pattern <br />(off -shore clusters of residential properties with a minimum lot size of <br />20,000 square feet) and density (approximately 1.2 acres of subdivided <br />land and open space per platted property; approximately 50 percent of <br />the area in common open space) presumes that zoning regulations <br />and/or subdivision and sanitary control ordinances will not change <br />substantially over the term of the project's development (i.e., that <br />subdivision will continue to be regulated primarily by existing regula- <br />tions enforced by Burnett County and the State of Wisconsin pertain- <br />ing to areas serviced by individual wells and private disposal sys- <br />tems). <br />A substantial change (e.g., the requirement of central or public sewer <br />and/or water facilities) in state or county subdivision or sanitary <br />control ordinances and/or the enactment of separate town ordinances <br />not in effect at the outset of this project may force and permit the <br />Developer to revise his plans regarding pattern and density of de- <br />velopment. <br />Section 2. Use and Eniovment of Common Properties <br />Each and every Member, his family members, and guests residing with him <br />in his household shall have the rights of the use and enjoyment of the <br />Common Properties, subject to restrictions stated in this Declaration and <br />other reasonable regulations which the Board shall have the power to <br />prescribe. <br />The Board and the assigns of the Association shall have the power to <br />impose and collect reasonable fees for the use of those facilities for which a <br />user -fee is deemed necessary. In the event that Developer or the Board <br />elects to make certain facilities available for public use as well as the use of <br />Members and guests of Members, any fee schedules established for such <br />facilities will be graduated to reflect preferential treatment in favor of: 1) <br />Members and their immediate families; 2) Guests of Members; and 3) the <br />general public, in that order. <br />The Board shall have the power to suspend a Member's rights to use and <br />enjoy the Common Properties for any period during which any assessment <br />remains unpaid, and for any period not to exceed the (30) days for any <br />infraction of the restrictions stated in this Declaration or its published <br />regulations for the use, protection and preservation of the Common Proper- <br />ties. <br />Section 3. Protection and Preservation of Common Properties <br />For the duration of the covenants and restrictions set forth in this Declara- <br />tion, the area of the Common Properties depicted in the final plats shall not <br />be reduced by sale or development. <br />No portion of the grounds depicted in the final plats shall be diverted to <br />residential development or facilities, subject to exceptions stated in this <br />Declaration. <br />7 <br />
