The submittal has been CONDITIONALLY APPROVED. The owner, as <br />defined in section 101.01(10), Wisconsin Statutes, is responsible for compliance with all conditions of this petition <br />approval and other applicable code requirements. Plan submittal to and approval by the department or its agent may <br />be necessary prior to construction undertaken per this petition. This petition approval may be affected if applicable <br />codes are revised prior to plan submittal for any necessary construction work. <br />The code section petitioned requires that POWTS treatment, holding and dispersal components shall be located so <br />as to provide the minimum horizontal setback distances as outlined in Table 383.43-1 as safety factors for public <br />health, waters of the state and structures in the event of component failure as per SPS 343(8)(i), W is. Adm. Code. <br />The variance requested is to allow a POWTS to be 3 feet from a building <br />The intent of the code section petitioned is to provide the minimum horizontal setback distances as outlined in <br />Table 383.43-1 as extra safety factors for public health, waters of the state and structures during construction and in <br />the event of component failure. <br />The petitioner submitted the SB-9890 application form including 4 additional pages of supporting documents and/or <br />plans. <br />
