After review of Department records, no <br />permit has been issued for wetland or lakebed discharge at this location, therefore the discharge constitutes a violation <br />of state statute. I concur with the remedy to remove the natural woody debris to place in an upland location compliant <br />with local zoning laws. Refuse shall also be removed and transported to a waste disposal facility. <br />Removal of the debris and refuse shall not disturb the natural elevation of the lakebed or wetland. No ground or <br />lakebed disturbance shall occur or the disturbance will result in additional dredging and/or wetland violations. The area <br />shall be allowed to naturally revegetate. <br />In addition to holding the land use permit, if the debris and refuse is not removed according to instruction within thirty <br />(30) days from this day, I will proceed with a Notice of Noncompliance and begin the Department's stepped <br />enforcement process to remedy the violation. I sincerely hope the property owner seizes the opportunity to resolve the <br />issue voluntarily. Please stake a new location and then I can do <br />another site visit. <br />2- There is wood, stumps, debris, wood, furniture being disposed of in the wetland which is about 30 ft from the <br />lake. This disposed material must be removed from the wetland and placed in a compliant area AND the refuse <br />
