STATE OF WISCONSIN CIRCUIT COURT BURNETT COUNTY <br /> County of Burnett, MEMORANDUM OPINION <br /> Plaintiff, <br /> VS. Case No. 97-FO-189 <br /> Carole Fox, <br /> Defendant. <br /> FACTS <br /> Fox was issued a citation for placing a mobile home on her <br /> property without a permit in violation of Sec. 6. 5 of the Burnett <br /> County Land Use/Zoning Ordinance. At trial, Fox 'admitted not <br /> applying for a conditional permit under the ordinance. Burnett <br /> County admitted a conditional permit would not be granted because <br /> the mobile home does not meet the requirements of Sec. 6 . 5 (5) which <br /> reads: <br /> All mobile homes allowed by conditional permit must meet <br /> the construction standards of the U. S. Department of <br /> Housing and Urban Development as evidenced by a HUD seal <br /> or stamp affixed to the mobile home. <br /> Section 101. 91, Wis. Stats. , defines "mobile homes" as vehicles <br /> built before June 15, 1976. Only mobile homes manufactured after <br /> June 16, 1976 , carry the U. S. Department of Housing and Urban <br /> Development seal of compliance. At trial it was admitted that the <br /> Fox mobile home was manufactured before June 15, 1976, and <br /> therefore, did not carry the HUD seal of compliance. <br /> Fox argues that Trade Lake has not adopted the Burnett County <br /> ordinance and because she has complied with all other aspects of <br /> the ordinance the HUD seal requirement should be waived on <br /> equitable grounds. <br /> 1 <br />
