STATE OF WISCONSIN CIRCUIT COURT BURNETT COUNTY
County of Burnett, MEMORANDUM OPINION
Plaintiff,
VS. Case No. 97-FO-189
Carole Fox,
Defendant.
FACTS
Fox was issued a citation for placing a mobile home on her
property without a permit in violation of Sec. 6. 5 of the Burnett
County Land Use/Zoning Ordinance. At trial, Fox 'admitted not
applying for a conditional permit under the ordinance. Burnett
County admitted a conditional permit would not be granted because
the mobile home does not meet the requirements of Sec. 6 . 5 (5) which
reads:
All mobile homes allowed by conditional permit must meet
the construction standards of the U. S. Department of
Housing and Urban Development as evidenced by a HUD seal
or stamp affixed to the mobile home.
Section 101. 91, Wis. Stats. , defines "mobile homes" as vehicles
built before June 15, 1976. Only mobile homes manufactured after
June 16, 1976 , carry the U. S. Department of Housing and Urban
Development seal of compliance. At trial it was admitted that the
Fox mobile home was manufactured before June 15, 1976, and
therefore, did not carry the HUD seal of compliance.
Fox argues that Trade Lake has not adopted the Burnett County
ordinance and because she has complied with all other aspects of
the ordinance the HUD seal requirement should be waived on
equitable grounds.
1
