As a consequence, you owe no duty to develop this road and may, <br /> by developing a portion, open up a can of worms as far as having to reopen the remaining portion of the <br /> road. <br /> It would be my suggestion that you not improve that road without going through the proper procedures to <br /> obtain authority for the road by the property owners and to draft a resolution to reopen the road. The reason <br /> you need authority to reopen the road is that your authority has lapsed as you have no ownership interest or <br /> easement interest in that road. <br /> In addition,by developing a portion of it you may be opening yourself to a claim by the remaining property <br /> owners that the road has been worked and as a consequence has been reopened and should be improved. <br /> In addition, by improving a portion the remaining property-owners may claim that you have opened a <br /> portion for one person you should open the portion for the others. <br /> This would result in quite an expense to the Township that's not necessary or required.
