i <br /> I <br /> Minerva Darn Preliminary Hazard Rating Page 2 <br /> hazard rating. <br /> ASSIGNMENT OF THE PRELIMINARY HAZARD RATING <br /> 1, The hydraulic and hydrologic analyses are hereby approved in accordance <br /> with Chapter 31, Statutes, <br /> 2. The preliminary hazard rating of Class 1A, Low Hazard, is hereby assigned <br /> to the dam. E <br /> 3. Hazard ratings of either I or II shall become null and void unless <br /> restrictive covenants are secured 'or local zoning is adopted for all lands <br /> affected by failure of the dam during the regional flood. Failure to <br /> secure appropriate restrictions on land effected within 1 year of the date <br /> of this assignment will automatically revert the classification to a hazard <br /> III category. <br /> 4. Plans for reconstruction or construction of the dam shall include a <br /> stability analysis in compliance with Wisconsin Administrative Code NR <br /> 333.05. The hydraulic capacities of the dam are to comply with the <br /> requirements of Wisconsin Administrative Code NR 333.07(2) and must be <br /> verified in the dam plans submitted to the Department for approval. <br /> NOTICE OF APPEAL RIGHTS h <br /> If you believe that you have the right to challenge this decision, you should <br /> know that Wisconsin statutes and administrative rules establish time periods <br /> within which requests to review Department decisions must be filed. <br /> To request a contested case hearing pursuant to s,227.42, Wis. Stats. , you have <br /> 30 days after the decision is mailed or otherwise served by the Department of <br /> Natural Resources.
