COMPREHENSIVE AMENDMENTS TO
BURNETT COUNTY LAND USE ORDINANCE
BURNETT COUNTY, WISCONSIN
SECTION 1.0 INTRODUCTION
1.1 AUTHORITY AND PURPOSE
Pursuant to the authority granted in Sections 59.97, 59.971, 59.99
and 87.30, Wisconsin Statutes, the Board of Supervisors of Burnett
County does ordain and enact as follows:
An ordinance regulating and restricting the location, construction
and use of building, structures, and the use of land in the
unincorporated portions of Burnett County and dividing the County
into districts.
1.2 APPLICABILITY
All of the towns of Burnett County are subject to county shoreland
and floodplain zoning within floodplain and shoreland areas described
in Sections 4.4, 4.5 and 3.1(14) of this Ordinance. The shoreland
section supersedes all the provisions of any county zoning ordinance
enacted under Section 59.97, Wisconsin Statutes which relates to
shorelands. However, where a county zoning ordinance enacted under
a statute other than Section 59.97, Wisconsin Statutes is more
restrictive, that ordinance shall continue in full force to the
extent of the greater restrictions but not otherwise.
1.3 INTERPRETATION
The provisions of this ordinance shall be held to be minimum
requirements, adopted for the promotion and protection of the public
health, morals, safety, or the general welfare. Whenever the
requirements of this ordinance are at variance with the requirements
of any other lawfully adopted regulations, ordinances, or private
covenants, the most restrictive, or that imposing the higher
standards, shall govern.
- 1 -
