CUP-19-24: Timberlake October 29, 2019 <br /> Burnett County Staff Report <br /> Application Request: <br /> To keep up to 10 chickens (hens only) on the parcel in a residential district. <br /> Current facts about the parcel: <br /> - PIN #07-032-2-41-16-35-5 15-049-013000, located in Section 35,T41N, R16W(Town of Swiss). <br /> - Zoned RR-2: 1.5 acre minimum lot size, minimum width 200 ft. 30-413. <br /> - The subject parcel is approximately 1.4 acres. <br /> - This parcel is non-conforming for lot width and lot area. <br /> - The current owners obtained the property via Warranty Deed Doc. #434614 recorded on <br /> 3/31/2015. <br /> - According to the FEMA floodplain map most of the parcel is within the floodplain. <br /> - According to the WI DNR wetland map there are no wetlands on the parcel. <br /> Applicable Conditional Use: <br /> Per 30-85(4), "Livestock or other agricultural practices,subject to conditions set by the land use and <br /> information committee." <br /> Permits of Record: <br /> - Land Use Permit#19741 issued on 8/8/1996 for a 26x45 garage. <br /> - Land Use Permit#25069 issued on 5/29/2001 for a 12x26 shed. This permit specifically noted <br /> not to be used for human habitation. <br /> - Land Use Permit#33548 issued on 4/15/2009 for an addition and deck. <br /> - LOMA issued by FEMA in 2012 removed the house,guest house and garage from the floodplain. <br /> - Sanitary Permit#SAN-17-72 issued on 5/26/2017 for a 2 bedroom system. <br /> Violations of Record: <br /> - Violation letter sent on 9/3/2019 about livestock in the RR-2. This CUP is trying to resolve this <br /> violation. <br /> - Shed was converted into a bunkhouse without proper permits. <br /> Comprehensive Plan: <br /> Town of Swiss Comprehensive Plan adopted in 2007 shows this area as rural residential district. <br /> - Rural Residential—These areas relate primarily to shoreland areas with modest density levels <br /> based on the lakes classification system of minimum lot size.A density threshold of one dwelling <br /> per 1.5 acres is projected in this category. <br /> Page 1 of 2 <br />
