04/10/1994 00:37 17156664206 WAGNER zURVEVII•IG rE�G,t r�l <br /> .- 299626 <br /> DEVELOPERS AGREEMENT <br /> PLANNED UNIT DEVELOPMENT <br /> This Agreement is made and entered into this 9th day of January, 1996 by and between <br /> the County of Burnett, State of Wisconsin ("Burnett") and Voyager Land Company, Ltd. <br /> ("Voyager"). <br /> RECITALS <br /> Whereas, Burnett approved on October 27, 1994 a rezoning of the following described <br /> real estate from RR-1, Residential-Recreation, to a Planned Unit Development District("PUD"). <br /> All that part of Government Lot 2, Section 18, and that part of Government Lots <br /> 3 and 6, Section 7, lying easterly and/or southerly of 1Wkare Road and westerly <br /> of the recorded Eighteenth Green Addition to Voyager Village Plat, Township 40 <br /> North, Range 14 West, Town of Scott. <br /> (the "Property"); and <br /> Whereas, Voyager intends to Plat a portion of the Property into one (1) outlot and <br /> twenty-four (24) zero lot line lots ("Town House Lots"); and <br /> Whereas, the rezoning of the Property to a PUD was conditioned upon the agreement of <br /> Voyager to certain restrictions related to the development of the Property as a PUD; and <br /> Whereas, Burnett and Voyager desire to memorialize the conditions upon which the <br /> approval of the PUD was conditioned. <br /> Now, Therefore, in consideration of the premises it is agreed as follows: <br /> 1. Voyager may plat a portion of the Property (subject to obtaining all required <br /> governmental approvals) to provide for the conveyance of the permitted twenty-four (24) Town <br /> House Lots. <br /> 2.
