Section 30-505(l) requires a shoreline <br /> vegetation protection area which extends from the ordinary high water mark to an area 25 <br /> feet less than the required setback for structures. In the area within 35 feet of the <br /> ordinary high water mark, no land disturbing activities are permitted except for the <br /> cutting of vegetation in one 30 foot wide view/access corridor. <br /> Section 30-507(2) requires permits for any filling or grading on slopes over 20% and for <br /> filling or grading over 1000 square feet on slopes between 12-20%. <br /> An onsite inspection on Lots 17 and 18 Plat of Whispering Pines of Spirit Lake on <br /> October 2, 2012 found violations of Section 30-505(1) and 30-507(2) (c), (d) and (e). <br /> Filling and grading within 35 feet of the ordinary high water mark; filling/grading on <br /> slopes greater than 20%; filling/grading greater than 1000 square feet or slopes greater <br /> than 12%; and filling/grading greater than 2000 square feet on slopes less than 12% <br /> within 300 feet of the ordinary high water mark of the lake. <br /> State and county violations of filling/grading below the ordinary high water mark in <br /> lakebed and dredging of lakebed also exist on Lots 17 and 18 Whispering Pines. <br /> Enclosed are citations for violations of Section 30-505(1) and 30-507(2). To correct <br /> these violations and prevent additional legal action the following restoration must be <br /> completed. <br /> All fill material must be removed from slopes greater than 20% and from all area within <br /> 50 feet of the ordinary high water mark. The disturbed area must be restored to original <br /> grade and slope. All disturbed area with slope towards the lake must be seeded and <br /> mulched. Erosion control silt fence must be property installed to prevent any additional <br /> erosion. <br />
