As you can see, about 200 <br /> square feet of the concrete patio encroaches on the 100-foot lake setback. As discussed,this may be <br /> permitted under Section 4.4(10),pages 45 &46. This will require a separate permit and a shoreline buffer <br /> restoration. <br /> In reviewing the permit record for your property, a sanitary permit and a garage permit were the only ones <br /> found. The addition to the living area(2-story, 12'x14')was never permitted. Section 9.2(1),found on page <br /> 67 of the Burnett County Land Ordinance,requires a Land use permit for all additions/alterations. <br /> Because these structures and additions were done without a Land Use permit,I'm issuing a citation for <br /> construction without a permit. <br /> To correct violation and prevent additional fine, a Land Use permit must be secured for the living area and <br /> retaining wall construction, and r. separate Lund Use permit must be secured for a 59.692(ly) structure <br /> (patio). If you choose not to apply for the 59.692 (1v)(200 sq. ft.patio)permit,the patio must be removed. <br /> I have enclosed 2 Land Use applications, copies of the ordinance referenced, 2 copies of our plot plan sketch, <br /> and a citation. <br /> You may appear at Burnett County Court at the date and time indicated on the front lower left of the citation <br /> to enter a plea,or you may pay the citation as indicated on the back.
