Lacek <br /> 10 South 5th Street, #1100 <br /> Minneapolis, MN 55402 <br /> Dear Mr. Lacek: <br /> On October 29, 1996, I inspected your property on Johnson Lake as per our <br /> earlier telephone conversation. The inspection found that you have a deck and <br /> patio constructed without permits and within the 75 foot setback of the ordinary <br /> high water mark. <br /> Section 9.2(1) of the Burnett Ccunty Land Use Ordinance states that no structure <br /> shall be built, moved, or structurally altered until a . wilding permit has been <br /> issued. Section 2.1(35) defines a structure as anything constructed or erected <br /> excluding utility poles. Section 4.4(1)(c) states decks, observation platforms, <br /> satellite dishes and bu _Idings, other than boathouse, are expressly prohibited <br /> in the shoreline setback (75 foot) area. <br /> The structures you have do not comply with our ordinance or the state shoreland <br /> requirements of Wisconsin Administrative Code NR115. These structures will have <br /> to be removed and the shoreland area restored to natural. <br /> Because of these violations, I have no ct-oice but to issue a citation. Although <br /> there are se,:- , ral violations, I 'm only issuing one citation for building without <br /> a permit. <br /> To correct the v'olations and prevent adcitional citations and/or legal action, <br /> the non-permitted structures must be removed.
