BURNETT COUNTY ZONING ADMINISTRATION <br /> BURNETT COUNTY GOVERNMENT CENTER <br /> 7410 COUNTY ROAD K,#102 PHONE(715)349-2138 <br /> SIREN,WISCONSIN 54872 <br /> April 9, 2009 <br /> Robert Gust, Consultant <br /> Central State Tower Holding LLC <br /> 10829 Columbus Drive <br /> Ferryville, WI 54628 <br /> Dear Mr. Gust: <br /> As indicated in my letter dated March 24, 2009 there was some questions and concerns <br /> regarding the action taken on your Conditional Use Permit#1287 for a cell tower. <br /> The ability of the Committee to allow a tower exceeding 199 feet in height given the <br /> language of Section 6.9(7)(d) was in question. <br /> The Burnett County Corporation Counsel (Dave Grindell) had been asked to review <br /> action taken on Conditional Permit #1287. Mr. Grindell has informed me that given the <br /> existing language of the Ordinance, the Committee could not have approved a tower <br /> exceeding 199 feet. FCC minimum requirements needs and no alternatives, such as <br /> multiple smaller towers, could not be shown. <br /> Mr. Grindell has advised the Committee that if towers exceeding 199 feet are desired, <br /> they should go through the planning process and amend the Ordinance. <br /> Because of the above input, action on Conditional Permit #1287 is to grant approval of <br /> the cell tower at a height not to exceed 199 feet. <br /> Please contact me if you have any additional questions. <br /> Sincerely, <br /> Jim Flanigan <br /> Zoning Administrator <br /> P.S.
