ARTICLE II. -NUISANCES['] <br /> Footnotes: <br /> ---ell--- <br /> State Law reference—Nuisances,Wis.Stats.ch.823. <br /> Sec. 18-19.- Purpose and intent. <br /> (a) The purpose and intent of this article is to protect the public health, safety and general welfare <br /> and to maintain and protect the environment for the people and communities of the county, and <br /> to: <br /> (1) Prevent communicable diseases. <br /> (2) Prevent the continuance of public nuisances. <br /> (3) Ensure that insects and rodents do not create a public nuisance and/or health hazard. <br /> (4) Ensure that surface and groundwater meet county and state standards and regulations. <br /> (5) Ensure that solid waste is handled, stored and disposed of according to state standards and <br /> regulations. <br /> (6) Ensure that citizens are protected from hazardous, unhealthy, or unsafe substances. <br /> (7) Provide the administration and enforcement of Wis. Stats. chs. 145 and 146,and 1983 <br /> Wisconsin Act 410 including groundwater and county land use ordinances. <br /> (b) It is not the intent of this article to prohibit acceptable farming practices by farmers as the term <br /> "farmer" is defined by the Wisconsin Farmland Preservation Law, Wis. Stats. ch. 91. <br /> (Ord. No. 91-1, § I, 3-21-1991) <br /> Sec. 18-20. - Public nuisances affecting health. <br /> The following are hereby declared to be public nuisances affecting health: <br /> (1) Failure to keep waste, refuse or garbage in an enclosed building or properly contained in an <br /> enclosed building or properly contained in a closed container designed for such purposes. <br /> (2) Failure to maintain property so as to avoid health and safety hazards. <br /> (3) Allowing any discharge into the environment of toxic or noxious materials in such <br /> concentrations as to endanger the public health. <br /> (4) Maintaining excessive numbers of pets (too many animals for the space as determined by the <br /> health officer or designee)that result in a health hazard to either the animal or human <br /> inhabitants or public health. <br /> (5) Allowing an accumulation of debris or salvageable material such as, but not limited to, metal <br /> or glass. <br /> (6) Accumulation of unused appliances, unless a designated transfer station. <br /> (7) Holes or excavations not properly posted or barricaded which constitute a safety hazard. <br /> (8) Abandoned wells not properly sealed. <br /> (9) Accumulations of decayed animal or vegetable matter,trash, rubbish, bedding, packing <br /> material, scrap metal or any material in which flies, mosquitoes, disease-carrying insects, rats <br /> or other vermin can breed, live, nest or seek shelter, exempting private compost piles. <br /> (10) All decayed,adulterated or unwholesome food or drink sold or offered for sale to the public. <br /> (11) Any animal which molests humans in any unprovoked circumstances including, but not <br /> limited to, passersby on public rights-of-way. <br /> (Ord. No. 91-1,§ II,3-21-1991) <br /> Sec. 18-21. - Designation of unfit dwellings and structures. <br />
