Your efforts are appreciated and have assisted in avoiding <br /> potential problems for both parties in the future. <br /> The right-of-way consists of an area forty(40')feet wide or twenty(2(y)feet either side from <br /> the center of the pole. However, Polk-Burnett does understand that due to limited sized properties, <br /> sometimes it is necessary to enter this corridor such is the case for you. Buildings that are located inside <br /> the right-of-way must meet the following criteria: <br /> 1) Access to Polk-Bumett facilities must be maintained. <br /> 2) Compliance with the National Electric Safety Code(NESC)which defines acceptable clearances <br /> when building near overhead power lines must be followed and adhered to. <br /> 3) The southernmost wall which will be placed inside the right of way should not be placed closer <br /> than fourteen(14')feet from the center of the power line pole. <br /> Upon reviewing the stakes which you have placed to identifying your building, provided that <br /> they are not moved closer to the power line,you are in compliance with the NESC code and have not <br /> prohibited access to Polk-Bumett's facilities. As we have discussed,following this will provide ample <br /> clearance from the overhead power line and will allow your construction to proceed.
