Apparently, indicating that we <br /> have done something wrong since we are not enforcing your HOA/Protective Covenants. <br /> Please note that Burnett County is not a member of your HOA, and we, therefore, have <br /> no authority or basis in which to enforce those covenants. This is true through-out the <br /> county, and has happened in numerous incidences. <br /> Therefore, if someone applies for a permit, and they meet our guidelines for issuance of a <br /> permit, we have no choice but to issue that permit. If this is a violation of a private <br /> covenant between homeowners in some type of HOA-the remedy for correction of that <br /> would have to be brought by the HOA. The county is not a party nor could we be in any <br /> regard. <br /> I note that you did get a judgment, which indicates that your HOA was correct <br /> prohibiting the rental of the property. This would prohibit them from renting the property <br /> subject to some type of remedy fashion by the court. I also note that you are on appeal, <br /> and that the circuit court therefore probably will not enforce its' order - pending the <br /> outcome of that appeal. If you loose on the appeal, it would appear that the rental of the <br /> property is permissible and the permit is therefore valid. If you win on the appeal the <br /> permit is still valid, but would be a violation of the Burnett County court order to proceed <br /> as it is a violation of the HOA/Protective Covenants. <br />
