-SEALOF
March 27, 2018
Write -Up for Linahon Violations
Burnett County Zoning Administration
Burnett County Government Center
7410 COUNTY ROAD K, #120
SIREN, WISCONSIN 54872
PHONE (715) 349-2109
November 20, 2012 — Dan and Julia Linahon apply for and receive a permit for a bunkhouse on
their property at 27468 Hill Road, Spooner, WI.
May 8, 2015 — Staff members Dale Beers (DB) and Shane Buchholz (SB) were on an inspection at
27476 Hill Rd (next door to subject property) and noticed a large amount of shoreland
excavation on the subject property. It is clear in our 2009 imagery that this lot was in a natural
state. During our site visit we found that there was an excessive amount of vegetative clearing
that exceeding what our county allows. We also found that rock retaining walls had been
placed within the required setback distance from a navigable water body. Lastly, the amount of
grading done within the buffer area greatly exceeded anything legal.
May 12, 2015 — First violation letter sent by SB. See attached.
May 18, 2015 —The Linahon's called SB and were informed what they needed to do to correct
the violations. This included removal of rock walls, erosion control measures, and reestablishing
vegetative buffer per Land and Water Conservation Dept. standards. They were informed that
they need to seek out the LWCD for a restoration plan.
July 23-24, 2015 — Cheryl Clemens sent a restoration plan to the Linahons. See attached
email/plans.
September 2-3, 2015 —The Linahon's applied for a permit to construct a new home on the
property in question. DB performed a site visit on September 3rd which made it apparent that
the rock walls had not be removed, the site is still prone to erosion, and little to no vegetation
had been reestablished. Gully erosion was starting to form.
September 9, 2015 — A permit was issued to construct the home contingent on the restoration
agreement being signed and recorded with our register of deeds office, and that the restoration
be carried out in full by November 11t, 2016.
September 17, 2015 — Restoration agreement from the Linahon's recorded with register of
deeds office.
October 7, 2016 — Paul Kent of Stafford Rosenbaum LLP sent a letter to our office stating we
could not require a buffer under pre -2015 Act 55 standards. The same day, SB returned the
