Grindell <br /> Corporation Counsel <br /> dgrindell@burnettcounty.or <br /> January 15, 2021 <br /> Keyon Brown <br /> Husch Blackwell LLP <br /> 120 South Riverside Plaza, Ste 2200 <br /> Chicago IL 60606 <br /> Re: Voyager Village Common Ground Management Plan <br /> Dear Attorney Brown: <br /> I apologize for having been delayed in getting back to you regarding the above referenced <br /> matter, but I wanted to schedule a meeting with Jason to discuss exactly what the issues <br /> were, and what we have from a stand-point of Burnett County. <br /> Your email of December 21, 2020, did not include the changes that occurred with <br /> Voyager Village Property Owners Association. In June of 2002, Voyager Village <br /> Property Owners Association applied for a petition for zoning amendment that effected <br /> their property in the Towns of Jackson, Scott and Webb Lake. <br /> The amendment incorporated a residential-recreation plan drawn by the Voyager Village <br /> Property Owners Association and indicated that all the property would be subject to the <br /> residential-recreation plan, if the amendment was adopted. This plan, as stated in the <br /> application, effected water front property, including the recreational trails, swimming <br /> areas, dock locations, marina areas, mooring slips and beach houses in all of the lakes <br /> owned by Voyager Village at the time. It specifically limited the number of mooring <br /> slips in each lake. Birch Island at the time had 18 slips. <br /> The residential-recreation plan that was presented and approved, as part of the approval <br /> of the petition for zoning, limited the number of docks to 30 on Birch Island. Similarly, it <br /> limited the use of all other lakes owned by Voyager Village. <br /> At this point, it would seem to me that absent a change in the agreement Voyager Village <br /> entered into with Burnett County when the zoning amendment was adopted, we cannot <br /> authorize any use of the property that would violate Voyager Village's own residential- <br /> recreation plan, as provided to us, as a basis for approving of the amendment. <br />
