BURNETT COUNTY CERTIFIED SURVEY MAP NO. <br /> LOT I OF CERTIFIED SURVEY MAP NO. 1415 (C.S.M. VOL. 7 PG. 109) <br /> (DOC. NO. 217584) BEING PART OF GOV'T LOT 6 OF SEC. 9,T. 38 N., <br /> R. 15 W.,TOWN OF LAFOLLETTE, BURNETT COUNTY, WISCONSIN. K ,.,„,OR,,,,,,, , ,,,OW,„,sore <br /> SURVEYOR'S NOTES: <br /> (I)There is a major discrepancy between the record data mapping and describing the position of the point of <br /> beginning as shown on the record document for the original July 1980 Elliott survey of CSM 1415 and what <br /> has been recovered in this current survey. The January 1983 Wagner survey of CSM 1679 shows a monument <br /> in this location on their map and that position matches our recovered position.The fact that this monument <br /> was shown gives us the current ability to prove the monument has been in the current position for nearly 40 <br /> years and is likely in it's original position. There is no apparent evidence to support the monument having <br /> been disturbed and moved. There is no apparent evidence of lines of occupation or use to indicate another <br /> historic property line in this area. I accept the position of the found monument as the original position os <br /> set by Elliott in the field (and called for). In my opinion, the error is in the office calculating and mapping. <br /> The record documents are in error, not the position of the monument in the field. I therefore hold the found <br /> monument as the controlling position for this resurvey and in doing so correct the error in the record. <br /> (2) The status of the right of way of Bertram road is a mess in this area. There is a rood record for a 3 rod <br /> town rood along the west half of the section line between sections 4&9 as noted on the face of this map. <br /> The existing centerline and traveled roadbed does not match. The remainder of the traveled roadbed to the <br /> south (along the east line of this survey) has no apparent road records and was not included in the plat(no <br /> dedication) of Rowe's Addition, or the unrecorded plat of Rowe's Addition, although shown as a 66 foot Town <br /> Road on both documents. One could argue, Rowe being the owner at that time, intended or planned to <br /> dedicate the road or had acquiesced to it being a 66 foot wide town road as traveled prior to the platting. It <br /> is clear in the field this road hos been used by the public in its current position for many years and there is <br /> not doubt it meets the minimal requirements of prescriptive use. Consult your attorney regarding how the <br /> different interpretations of the right of way may encumber your property. <br /> (3)Subsurface and environmental conditions were not surveyed,examined or considered as part of this <br /> survey. No statement is made concerning the existence of underground or overhead conditions, containers or <br /> facilities that may affect the use or development of this property other than what is shown on this mop. In <br /> providing this boundary survey no attempt has been made to obtain or show data concerning existence, size, <br /> depth, condition,capacity or location of any utility existing on the site, whether private, municipal or public <br /> owned other than what is shown on this map. <br /> SURVEYOR'S CERTIFICATE: <br /> t Gregory J.
