As Proented fir Adopoon Augur 9,202/ <br /> Interim Zoning Ordinance. For purposes of this interim Zoning Ordinance, the term <br /> "existing uses" means those uses described and depicted in the map adopted as part of <br /> the Comprehensive Plan, which map is attached hereto as Exhibit B, incorporated by <br /> reference and made a part of this Interim Zoning Ordinance. <br /> 3.2 During the period when this Interim Zoning Ordinance is in effect,no person owning <br /> real property in the Town shall erect or construct any improvement that is deemed by <br /> theTown to change the existing use or change or attempt to change any existing use of <br /> real property in the Town. Notwithstanding the foregoing. a person may construct an <br /> improvement or use real property if such improvement or use is consistent with land uses <br /> previously existing or previously approved by the Town Board. <br /> 3.3 Any and all requests for construction of improvements or determinations as to <br /> whether an anticipated use of real property is consistent with this Interim Zoning <br /> Ordinance shall require prior review and a determination that the request is consistent <br /> with the terms and conditions of this Interim Zoning Ordinance. To initiate the review <br /> process, a written application for a review and determination must be filed with the Town <br /> Clerk. At a minimum, the applicant should provide a description of the anticipated <br /> construction, improvement and/or use as well as an explanation sufficient for the Town to <br /> determine whether the request is consistent with the terms and conditions of this Interim <br /> Zoning Ordinance. The Town Clerk shall notify all adjoining property owners of such <br /> application and shall forward the application to the Plan Committee for initial review <br /> and recommendation. The Plan Committee shall determine if the application is complete <br /> and may request additional information from the application. Following review of a <br /> complete application, the Plan Committee shall make a recommendation to the Town <br /> Board as to whether the anticipated construction, improvement or use is consistent with <br /> the Interim Zoning Ordinance and compatible with neighboring uses or uses previously <br /> approved by the Town Board. The Town Board shall review the Plan Committee's <br /> recommendation and make the final determination. <br /> 3.4 Any construction, improvement or use that is inconsistent with this Interim Zoning <br /> Ordinance is strictly prohibited. Any person who violates the terms of this Interim <br /> Zoning Ordinance, as determined in the sound discretion of the Town Board, shall be <br /> required to remove such improvement or construction,discontinue such inconsistent use, <br /> and restore the real property to its original condition. The Town shall have the right, but <br /> not the obligation,to pursue injunctive and compensatory relief for violations, along with <br /> the costs of prosecution,including actual attorney fees. Violations of this Interim Zoning <br /> Ordinance shalt also be subject to a penalty of no less than $500.00 per violation, along <br /> with the costs of prosecution, including actual attorney fees. Each day that a violation <br /> exists or continues shall be considered a separate violation. <br /> Section 4- MISCELLANEOUS PROVISIONS <br /> 3 <br />
