Your variance for the property dated 9/08/08
requires a buffer restoration plan as a condition.
The buffer zone/vegetation protection area requirements in Burnett County ordinance are as
follows:
A 50 feet deep vegetation protection area is required with a 75 foot setback as allowed with your
variance. The vegetation protection area(the buffer) consists of two major components: the first
component(35 feet deep) is a no-touch, natural vegetation zone, and the second component is a
minimum maintenance zone. A single viewing/access corridor up to 30 feet wide may cross both
zones perpendicular to the shore. Vegetation removal and land disturbing activities are
prohibited in the no-touch zone. Limited pruning and mowing are allowed in the
viewing/access corridor and the minimum maintenance zone. Walkways, pathways, and
stairs must be located in the viewing/access corridor; and piers, wharfs and lifts must be placed
in water immediately in front of the corridor.
Existing vegetation on the lot meets the buffer requirements with the exception of the area
where the existing cabin and cement slab and walkway are located. To fully meet buffer
restoration requirements, the cement sidewalk on the lakeside running parallel to the
structure and the cement slab to the side of the structure must be removed and planted.
Any disturbed area within the 35 feet deep no-touch zone must be revegetated with native
flowers and grasses.Note that the existing cabin is set back 36 feet from the ordinary high water
mark, so most of the area where the sidewalk is removed would need to be replanted with native
vegetation. Remaining areas where the cement slab and cabin are removed may be planted to
lawn if desired.
