EDWARD J CYCENAS NOTICE OF MOTION AND MOTION FOR ORDER GRANTING DISMISSAL Notice is hereby given that defendant in error does and by these presents moved the court to dismiss with prejudice all claims by Plaintifffor the reasons put forth hereinafter; Praceipe/Demand for Order of Dismissal Comes now Edward Joseph Cycenas,unwillingly made trustee of the trust EDWARD J CYCENAS stating,commanding and moving the court thusly;That I do this action and state that all facts herein, are true,correct,and materially complete to the"best of my ability,based on firsthand-knowledge and/or information-and-belief and I affirm that I do here-in under the pains and penalties of perjury pursuant to the Laws of the United States ofAmerica,expressly with-out the UNITED STATES (Federal Zone). Comes now, Edward Joseph Cycenas,hereby denying any and all statements put forth by DAVID L GINDELL as false,tiivolous, specious,superfluous,untrue,misleading or otherwise irrelevant or unsupportable of the propositions put forth by DAVID L GRINDELL Comes now Edward Joseph Cycenas,having on the 26`h day of February 2010,moved this court for a dismissal and Plaintiff BURNETT COUNTY(Sic)(not county of Burnett)having had an opportunity to Respond to the Claims my claims and having substantially failed to respond to the facts set fourth;and, having misrepresented the issues put fourth by EDWARD J.CYCENAS; and,plaintiff having substantiated the"Navigable Waterways" foundation of plaintiffs false claim falsely applied; and, plaintiff having made all necessary admissions to the inapplicability of ORDIENANCE 15.14 to the private land claim of Edward Joseph Cycenas;and,plaintiff having failed to request of the court any action to deny the dismissal;now,therefore the court must DISMISS FACTS The Rules of Law binding the Judge herein are as follows; 1. The Court can grant no relief not requested/moved and supported by a properly sworn pleading and the only party to validly requested any action is myself,Edward Joseph Cycenas,and not even the Original "CITATION"on the Plaintiffs part constitutes a request properly sworn and before the Court.
