September 6, 2017 — Honorable Judge Melissa R Mogen approved the inspection warrant. <br />September 13, 2017 — Special inspection warrant was served with Deputy Christopher Culvey, <br />DB, JT, and SB. Detective Julie Mead showed up on site concerned for the Deputy's safety when <br />he missed a radio call from dispatch. See write up for details. Basically, staff verified that the <br />outdoor showers existed, and that two filter basins (tanks) with two separate sanitary filters <br />were installed without sanitary permits as required by SPS 383. <br />September 29, 2017 — JT filed a report of the served search warrant with the Circuit Court. It <br />was authenticated on October 6, 2017. <br />November 15, 2017 — Two citations were issued to KA for discharging wastewater to the <br />surface of the ground (showers), and unpermitted modification to a POWTS Treatment <br />Component (Filters and Basins). <br />SPS 381.01 (78) "Domestic wastewater" means the type of wastewater, not including storm <br />water, normally discharged from or similar to that discharged from plumbing fixtures, appliances <br />and devices including, but not limited to sanitary, bath, laundry, dishwashing, garbage disposal and <br />cleaning wastewaters. <br />SPS 381.01 (178) "Plumbing fixture" means a receptacle or device which meets at least one of the <br />following: (a) Is either permanently or temporarily connected to the water supply system of the <br />premises, and demands a supply of water from the system; (b) Discharges wastewater or waste <br />materials either directly or indirectly to the drain system of the premises. (c) Requires both a water <br />supply connection and a discharge to the drain system of the premises. <br />SPS 381.01 (186) "POWTS treatment component" means a device or method that is intended to <br />reduce the contaminant load of wastewater. <br />SPS 383.32 Prohibitions (1)(f) The final discharge of domestic wastewater or POWTS effluent to <br />the ground surface is prohibited, including by means of plumbing outfall pipes existing prior to July <br />1, 2000. <br />Sanitary Permits SPS 383.21(1) General <br />(a) Pursuant to s. 145.19, Stats., the installation or construction of a POWTS may not commence or <br />continue unless all of the following have been fulfilled: <br />1. The owner of the property on which the POWTS is to be installed possesses a valid sanitary <br />permit. <br />2. Plan approval for the POWTS has been obtained in accordance with s. SPS 383.22. <br />(b) The modification of an existing POWTS may not commence or continue unless the owner of the <br />property on which the POWTS is located possesses a valid sanitary permit and has obtained plan <br />approval for the modification under s. SPS 383.22, if the modification involves the addition or <br />replacement of any of the following: <br />1. A POWTS holding component. <br />2. A POWTS treatment component. <br />3. A POWTS dispersal component. <br />
