Grindell <br />Corporation Counsel <br />DATE: May 12, 2010 <br />RE: Lucy Basler Request <br />Dear Jim: <br />You have asked me to review the letter from Lucy Basler, along with her response. <br />While I have not necessarily gone into the disposition of cremated remains, it would be <br />my understanding that her interpretation is correct provided they are processed to meet <br />the requirements of the statutory section that she cites in her letter. <br />My bigger concern is the use of the property for ceremonies such as weddings and <br />funerals on their property. <br />You have indicated that the property is zoned RR3, which would allow under conditional <br />permit recreational services, public and semi -private uses. The use of the property by <br />outside people for these types of events, in my opinion, would require a permit even if <br />there is no fee being charged for the use of the property. I do not believe that the fact is <br />that it's a viable economic use, is the key to whether or not a permit is needed, but <br />whether the use of the land meets the requirements for conditional use permits regardless <br />of any funds being charged or made. <br />The purpose of the conditional use permit is to put conditions on it so that it will coincide <br />with their surrounding area. While it may be that the conditional use permit would be <br />granted with very limited conditions, it may also be that in order to fit into this particular <br />area some conditions may be necessary for the time of day, amount of people, length of <br />ceremony, and such. <br />Ms. Basler has also indicated that she has opened this up for people to walk the trails and <br />use it for hiking. I do not know if a permit would be necessarily granted for that provided <br />
