The violation <br />notice also indicated that there was a violation of the setback to the ordinary <br />high water mark. <br />A second notice was issued to you in September of 1988 indicating the portion <br />of the deck which was too close to the ordinary high water mark of the lake <br />would have to be removed. You were also sent a variance application which <br />would allow you to apply for a reduced setback. <br />Because you have failed to comply with the Land Use requirements and have not <br />corrected the violation, I am sending you another citation for constructing a <br />deck too close to the ordinary high water mark of Bass Lake. <br />Further citations or other legal action will be continued until violations are <br />corrected. <br />Sincerely, <br />James P.
