Developer declares that the real property in the development, including such <br />additions as may hereafter be made thereto (as provided in Section 2 of <br />Article 1), is and shall be held, conveyed and occupied subject to the cov- <br />enants, restrictions, easements, charges and liens set forth in this Declara- <br />tion. <br />ARTICLE I <br />DEFINITIONS <br />The following words or phrases, when used in this Declaration or any <br />Supplementary Declaration of Covenants and Restrictions (unless the <br />context shall prohibit) shall have the following meanings: <br />(a) "Developer" shall mean and refer to Voyager Village, Inc., a wholly - <br />owned operating subsidiary of N.E. Isaacson and Associates, Inc. <br />(b) "Association" shall mean and refer to The Voyager Village Property <br />Owners' Association, Inc. <br />(c) "Properties" shall mean and refer to all such Existing Property (as <br />provided in Section 1 of Article 11) and additions thereto from <br />Additional Property (as provided in Section 2 of Article 11) as are <br />subject to this Declaration or any Supplementary Declaration of <br />Covenants and Restrictions. <br />(d) "Lot" shall mean and refer to any numbered lot shown upon any <br />recorded final plat of the Properties. <br />(e) "Living Unit" shall mean and refer to any portion of a residential <br />building situated in an area of the Properties set aside for <br />Condominium Property (as described in Article V) and designed and <br />intended for use and occupancy as a residence by a single family. <br />(f) "Common Properties" shall mean and refer to those lands shown <br />upon any recorded plat of the Properties, that are not lots or Condo- <br />minium Property, and are intended to be devoted to the common <br />use and enjoyment of the Owners. <br />(g) "Owner" shall mean and refer to the record owner, whether one or <br />more persons or entities, of a fee, or undivided fee, interest or to a <br />person or entity, which has an interest as a contract purchaser in <br />any Lot or Living Unit situated upon the Properties, but shall not <br />mean or refer to any person or entity who holds such interest merely <br />as a security for the performance of an obligation. <br />(h) "Member" shall mean and refer to any Owner who is a member of <br />the Association. <br />(i) "Board" shall mean and refer to the Board of Directors of the <br />Association. <br />3 <br />
