BURNETT COUNTY ZONING ADMINISTRATION
BURNETT COUNTY GOVERNMENT CENTER
7410 COUNTY ROAD K,#102 PHONE(715)349-2138
SIREN,WISCONSIN 54872 FAX (715)349-2166
NOTICE OF LAND-USE VIOLATION
6/29/15
Tim McCulloch
4946 County Rd J
Menomonie, WI 54751
Mr. McCulloch,
We are writing with some concerns with your property at 4662 Lake 26 Rd, Danbury, WI. The
first is that we can only grant you your camping permit for the 6 month time-frame with the
condition that the"shack" dictated on your plot plan be used for day-use purposes only. Nobody
will be allowed to sleep in this building until a dwelling permit is obtained. At that point you will
no longer be able to obtain camping permits on the lot. Speaking to old zoning staff, this has been
the situation for years that this "accessory structure" is being developed into a cabin, eventually.
Once you intend to live in this building you must receive a permit immediately.
Our second concern is the addition work that has been done to this"shack"without a permit. We
notice the roof-line has changed entirely based on previous aerial photos, and you have
cantilevered a house addition off the NE corner of the building. You need to get an after-the-
fact permit for an addition to accessory structure or principal structure (dependant on its use)
through our department. That permit will cost three times the normal fee per this violation
response. However, your whole parcel is mapped as being in a floodplain and you may not obtain
a permit without proving the structure is built at or above regional flood elevation. Contact a
Wisconsin Licensed Surveyor to discuss this process. This process needs to be completed or the
changes to structures removed by no later than 9/15/15. I want you to also consider that doing
additions to nonconforming structures (in this case, to the road) is limited over the lifetime of the
structure to only 50% structural members, and only 50% three-dimensional space expansion,
whichever is more limiting.
Lastly, we notice that you have water tied to your camper and no sewer connection completed by
a master plumber. It is in direct violation to state sanitary code to discharge grey and/or black
water to the ground surface, and must be ceased immediately. Remove all sources of water from
the camper, or tie it to your sewer system via master plumber or you will be cited. Contact our
department with any questions you may have.
If you want to treat this building as a principal structure, we must deny your permit for a camper
and the unit is to be removed when your 30 calendar days per year is up.We will hold the permit.
Sincerely
Shane Buchholz
Zoning and POWTS Specialist
