STATE OF WISCONSIN <br /> DEPARTMENT OF NATURAL RESOURCES <br /> WETLAND AND WATERWAY GENERAL PERMIT FOR MUNICIPALITIES TO <br /> CONSTRUCT, RECONSTRUCT OR MAINTAIN HIGHWAYS, BRIDGES, ARCHES <br /> AND CULVERTS <br /> Permittee: Municipalities such as a city, town, village or county <br /> Permit No. WDNR-GP2-2017 <br /> Issuing Office: Environmental Analysis and Sustainability Program, <br /> Wisconsin Department of Natural Resources (DNR) <br /> Issuance Date: November 3, 2017 <br /> Expiration Date: November 3, 2022 <br /> GENERAL PERMIT AUTHORIZATIONS: In compliance with the provision(s) of Wis. <br /> Stat. § 281.36 (3b)(b), no person may discharge/place dredged or fill material into a <br /> wetland unless the discharge is authorized by a wetland general permit or individual <br /> permit issued by the Department of Natural Resources (department or DNR) or the <br /> discharge is exempt by statute. In compliance with the provision(s) of Wis. Stat. § <br /> 30.123(2), unless an individual or a general permit has been issued by the department <br /> or authorization has been granted by the legislature, no person may construct or <br /> maintain a bridge or construct, place, or maintain a culvert in, on, or over navigable <br /> waters. <br /> Pursuant to Wis. Stat. § 281.36 (3g)(a)10., the department shall issue a general permit <br /> for a discharge to wetlands that is necessary for the construction, reconstruction, or <br /> maintenance of a bridge or culvert that is part of a transportation project that is being <br /> carried out under the direction and supervision of a city, village, town, or county. <br /> Pursuant to Wis. Stat. § 30.123(7)(d), the department shall issue a general permit to <br /> construct, reconstruct, and maintain bridges and culverts that are part of a transportation <br /> project that is carried out under the direction and supervision of a municipality <br /> ("municipality" means any town, village, city or county in this state). <br /> Municipalities may apply for coverage under this general permit to construct, reconstruct <br /> or maintain highways, bridges, arches and culverts and will comply with the terms and <br /> conditions of WDNR-GP2-2017. Please refer to the following sections of this permit for <br /> the specific eligibility standards, application requirements, certification requirements and <br /> responsibilities, conditions, findings of fact, conclusions of law, and definitions required <br /> by WDNR-GP2-2017. <br /> OTHER AUTHORIZATIONS NECESSARY: WDNR-GP2-2017 authorizations are <br /> subject to all applicable terms and conditions specified in this permit.
