The Department has authority under s.NR 812.43,Wis. Adm. Code,to grant a variance from ch.NR 812 <br /> requirements when strict compliance is impracticable. Variance approval may be conditioned on compliance <br /> with comparable specifications prescribed by the Department. Comparable specifications are based upon the <br /> need to protect drinking water and groundwater from contamination. <br /> Based on the grade level in the crawl space and the accessibility that will be provided for the well and <br /> pump installation,terminating the topthere ore well der the crawl space should not have an adverse <br /> rtment <br /> impact on the well. Depaappr d e granted for a variance from Chapter NR 812, <br /> Wis.Adm. Code requirements to allow the well to be constructed under the crawl space at the above <br /> property. <br /> This variance is granted based on information provided to the Department by the well owner.The <br /> information provided to the Department is assumed to be accurate and this variance approval is <br /> granted based on that information. Department staff have not inspected the well and water system <br /> which are the subject of this variance approval. This variance approval is not intended nor should it <br /> be deemed as a guarantee that the well and pump installation are in compliance with the Wisconsin <br /> Well and Pump Installation Code(ch.NR 812,Wis.Adm. Code),nor does it guarantee that the <br /> system will produce acceptable water quality or quantity. This variance is granted for the specific <br /> code provision or provisions identified above,subject to the following conditions: <br /> 1. That the well is constructed in the area of the crawl space where the grade is level with the <br /> outside grade. <br /> 2. That the well location complies with Chapter NR 812.08 separation distance requirements in <br /> relation to contamination sources and is not downslope of a contamination source. <br /> 3. That the well is constructed with a minimum of 25 ft. of casing(excluding the screen) or to a <br /> depth 10 fl. below the water table in the well,whichever is greater. <br /> 4. That the top of the well pipe terminates at least 12 inches above grade. <br /> 5. That an access door is provided to the crawl space and a removable hatch installed through the <br /> floor directly above the well. <br /> 6. That the attached well construction report identifying this well as having Unique Well#KT 069 <br /> is completed and submitted to this office after the well point is installed.. <br /> Failure to comply with any terms or conditions of this approval voids the approval.You are also <br /> responsible for acting in compliance with all other applicable statutory and administrative code <br /> requirements. <br /> NOTICE OF APPEAL RIGHTS <br /> If you believe that you have a right to challenge this decision,you should know that Wisconsin statutes and <br /> administrative rules estabhsh time periods within which requests to review Department decisions must be <br /> filed. <br /> For judicial review of a decision pursuant to sections 227.52 and 227.53, Stats.,you have 30 days after the <br /> decision is mailed,or otherwise served by the Department,to file your petition with the appropriate circuit <br />
