At the June 4, 2019 Committee meeting the Committee voted to require Chelmo to <br /> submit additional information and it continued further actions regarding CUP-19-12 until <br /> September 3, 2019. <br /> 11. Subsequent to the June 4, 2019 Committee meeting Chelmo submitted additional <br /> information to the Committee. <br /> 12. The Committee next considered CUP-19-12 on February 4, 2020. <br /> 13. At the February 4, 2020 Committee meeting Chelmo appeared in person and with <br /> both counsel and an engineer in order to address any Committee questions. <br /> 14. At the February 4, 2020 Committee meeting the Committee conducted a general <br /> public comment period with a three-minute speaking limitation per speaker, did not conduct a <br /> public hearing on CUP-19-12, and did not engage in any direct discussion with Chelmo. <br /> 15. At the February 4, 2020 Committee meeting the Committee voted to "dismiss" <br /> CUP-I 9-12. <br /> 16. In correspondence dated March 4, 2020 the Burnett County Zoning Administrator <br /> informed Chelmo that the Committee had completed a filed written decision on CUP-19-12 and <br /> that CUP-19-12 was "dismissed." The filed written decision is attached hereto and incorporated <br /> herein as Exhibit A. <br /> 17. The Committee's action that "dismissed" CUP-19-12 is in effect a denial of CUP- <br /> 19-12. <br /> 18. Pursuant to Wis. Stat. § 59.69(5e)(e), if a county denies a conditional use permit <br /> application,said denial may be appealed to the circuit court under the procedures contained in Wis. <br /> Stat. § 59.694(10). <br /> 3 <br />
