Zoning Committee Meeting
August 3, 1999
Page
WAGNER SURVEYING
Mark Krause from Wagner Surveying was asking the Committee what direction he
should take to get approval for a 4 lot certified survey map. This is some of Howard
Wagner's land, but not part of the campground. There is no lakeshore frontage for these
lots. The pre-application states that lakeshore access is to be provided for these 4 lots.
The Land Use Ordinance now requires that a conditional use permit be applied for when
creating lake access lots for backlots. One of the questions is that part of this access lot
might be lakebed—can you plat lakebed? Was this an existing outlot under the old rules?
An Attorney General's opinion says that a lot is already created if public waters and
public roads separate it. This does not meet the criteria of CSM's. Can this outlot be
created, but not used for access? Flanigan was directed to bring this to our Corp. Counsel
for advice.
OFFICE BUSINESS
Motion made by Bohn to recommend approval of the Zoning Office's 2000 budget to
Finance Committee. Motion second by Engelhart. Motion carried.
Motion made by Peterson to approve the vouchers, second by Engelhart. Motion carried.
Motion made by Bohn to approve a voucher submitted by Land Information, second by
Peterson. Motion carried.
Motion made by Engelhart to approve the minutes of the July meeting, second by Poretti.
Motion carried.
Flanigan would like to designate Keith Stoner as a Deputy or an Assistant. The
Committee agreed with this and Flanigan will discuss it further with Myron Schuster.
Flanigan discussed a D'Jock variance that was granted on October 3, 1994. It stated that
Mr. D'Jock was allowed to construct "a dwelling" at reduced setbacks to Bonner Lake
and to Kilkare Road. The recorded CSM states that the variance was granted for
"building setbacks". The question is whether or not Mr. D'Jock can build a new shed at
these reduced setbacks. The Committee referred it back to the Board of Adjustment.
Chairperson Poretti adjourned the meeting.
Respectfully submitted,
Sue Main,Zoning Technician
Approved by:
Susan Bohn, Committee Secretary
