MAP-15-d2: Sommerfeld March 26, 2015 <br /> Burnett County Staff Report <br /> Application Request: <br /> Rezone the existing parcels from A to A-2. <br /> Current facts about the parcel(s): <br /> - PIN#07-024-2-39-14-33-102-000-011000 and PIN#07-024-2-39-14-33-103-000-011000, both <br /> located in Section 33,T39N, R14W (Town of Rusk). <br /> - The current parcels total approximately 80 acres. <br /> - The current owner obtained the parcels in 1977 via Warranty Deed Doc#204184. <br /> - According to the FEMA floodplain maps,there are no floodplains on the parcels. <br /> - According to the DNR wetlands maps there are some small wetlands on each parcel. <br /> Reason for Rezone Request: <br /> Unknown. <br /> Comprehensive Plan: <br /> According to County records,the Town of Rusk does not have a Comprehensive Plan. The zoning map is <br /> to be used. Area is currently zoned as A. <br /> Standards for rezoning for A districts per County Ord 30-121(b)—decisions shall be based on findings <br /> that consider the following: <br /> - Adequate public facilities to serve the development are present or will be provided. <br /> - Provisions of these facilities will not be an unreasonable burden to local government. <br /> - The land is suitable for development. <br /> - Development will not cause unreasonable air or water pollution, soil erosion or adverse effects <br /> on rare or irreplaceable natural areas. <br /> - The potential for conflict with remaining agricultural uses in the area. <br /> - The need of the proposed development location in an agricultural area. <br /> - The availability of alternative locations. <br /> - The productivity of the agricultural lands involved. <br /> - The location of the proposed development to minimize the amount of agricultural land <br /> converted. <br /> Standards for rezoning for A districts per Stat 91.48(1)—(Not applicable at this time,however may be <br /> required in the future if zone A is included in the Farmland Preservation District which the County is <br /> required to adopt by 1/1/2016)—decisions shall be based on findings that consider the following: <br /> - The land is better suited for a use not allowed in the farmland preservation zoning district. <br /> - The rezoning is consistent with any applicable comprehensive plan. <br /> - The rezoning is substantially consistent with the county certified farmland preservation plan. <br /> Page 1 of 2 <br />
