December 3,2024 <br /> Page 3 of 5 <br /> CONDITIONAL USE PERMIT #CUP-24-28 —BENHARDUS Public notice is hereby given <br /> to all persons in the Town of Anderson, Burnett County, Wisconsin, that Walt and Linda <br /> Benhardus have made an application for a conditional use permit per the terms of the Burnett <br /> County Land Use Code of Ordinances to allow two horses in a residential zoning district on the <br /> parcels with tax ids: 36933 and 36934, on Bur Oak Trl, in the RR-3 zoning district, Lots 4 and 5, <br /> CSM Vol. 30 Pg. 325,in the SW '/4 of the NW '/4, Section 23,T37N,R19W. <br /> Shann Benhardus stated he is here on behalf of his parents and they are buying this parcel and <br /> they would like to have two horses on the property for recreational use. <br /> Chairman Conroy asked what the sexes of the horses are. If they would decide to have a foal, it <br /> would not increase the amount of horses until it was a year old. <br /> Walt Benhardus, via phone, stated one is a gelding and one is a mare. They do not intend to have <br /> any foals. They are just recreational horses they would bring to the property. <br /> Chairman Conroy stated they should have a manure management plan. <br /> Public hearing open. <br /> Don Hamilton encouraged the committee to support this CUP. He would like to see a condition <br /> that this CUP would end if this property were to sell to another owner. <br /> Public hearing closed. <br /> Mr. Towne stated the Town of Anderson has no objections. <br /> Committee discussion ensued. <br /> Burnett County Staff Report Item — If considering approval then the following item(s) may be <br /> included in the motion; these are part of the guidelines from the staff: <br /> 1. Not to exceed two horses at any time. <br /> 2. Follow all local, county, state and federal requirements for this activity. <br /> Motion to approve Conditional Use Permit #CUP-24-28 — Benhardus and to include staff <br /> recommendations was made by Supervisor Shimanski, seconded by Supervisor Moyer. Roll call <br /> vote: Supervisor Tucker, yes; Supervisor Moyer, yes; Supervisor Shimanski, yes; Supervisor <br /> Blomberg, yes; Supervisor Chuck Anderson, yes; Supervisor Karen Laqua Anderson, yes; <br /> Chairman Conroy, yes. Yes, 7;no, 0; absent, 0. Motion carried,roll call vote. <br /> LAND SERVICES—PROPERTY INFORMATION AND ZONING DIVISION REPORTS <br /> Mr. Towne submitted and reviewed his reports. <br /> DISCUSS ZONING ENFORCEMENT Administrator Nate Ehalt stated this is a conversation <br /> that has been discussed formally and informally in the past and they want a better understanding <br /> of direction the committee wants to go. He is going to provide some background information and <br /> is looking for feedback and direction from the committee as they move forward. Mr. Ehalt <br /> provided some history on zoning. Zoning enforcement is very tricky as it is a complaint driven <br /> enforcement. When an applicant applies for a permit the department looks at the property to <br /> make sure everything is compliant on the rest of the property. Mr. Towne reviewed a few <br />
