That"the present cause of action (based on Commercial Code 15.14)is not being brought for any <br /> legitimate purpose,and is a malicious prosecution,harassing litigation,and a pattern of activities by <br /> those sworn to be Public Servants and that I have sued said public servants"Witness(s)"and that they <br /> knew or should have known was not a"plumber"or other so regulated"licensed individual"for such a <br /> commercial code to be applicable to Myself,Edward Joseph Cycenas". <br /> g. That"BURNETT COUNTY'S claim is barred by Issue Preclusion for not having been brought at the <br /> time designated by the General Land Office of the United States for bringing such claim prior to the <br /> issuance of the Land Grant made Patent,the BURNETT COUNTY is now precluded from bringing <br /> such a claim at this late date,and that the land grant made Patent is conclusive against the government <br /> and all claiming junior interests there under." <br /> h. That"there is no requirement,nor can there be,to include private property in any corporation(such <br /> as BURNETT COUNTY,Inc.)or subject a common man's private property to CORPORATION <br /> REGULATIONS,this private freeman denies that the private property is "with-in"the <br /> CORPORATION of BURNETT COUNTY,and if found there,said presence is only on account of <br /> FRAUD,THEFT,UNJUST ENRICHMENT for which the CORPORATION has no legitimate claim of <br /> ownership nor right to regulate. That"BURNETT COUNTY whether by Fraud or Error makes the claim that they have the right to <br /> exist as any government body of, by and for the common man they are subject(for acting as a <br /> government)to the Wisconsin Constitution and the Enabling-Clause which in part states the"this State <br /> will never interfere with the primary disposal of land by the United States nor with any regulation <br /> congress puts forth for the securing of title in the bone fide purchasers thereof'and that said <br /> Congressional"regulation" is the private Land Grant madeap tent acting both as land grant and Positive <br /> Law Enacted,and secures in the grantee land and appurtenances,forever.And such determination by <br /> the land office is conclusive and cannot be revisited nor collaterally attacked such that this and every <br /> other attempt by anyone claiming to "exercise jurisdiction" would knowingly be doing so under color <br /> of authority in total absence of all jurisdiction any regulation would be color of law,as was the piece of <br /> paper alleged to be a"warrant"which bore no official seal of any valid court and was used to commit <br /> forcible entry under fraud" <br /> j. That"I,Edward Joseph Cycenas, have never granted, bargained,sold,or conveyed any part of myself <br /> or my private land and/or my private property,to be any part of"County" as the governmental unit;the <br /> BURNETT COUNTY ZONING ADMINISTRATION,nor do I receive any"privilege" or"benefit" <br /> from said CORPORATION" <br /> k.That"James Flanigan's name appears on the "Citation",wrote the citation, it was not <br /> certified/sworn/attested so as to be admissible as a complaint nor can it be the basis of any legitimate <br /> action on the part of any court,whether thru the willful acts of James Flanigan and or his gross <br /> negligence in not knowing the true application of commercial licenses and his misapplication of such" <br /> 1.That"I, Edward Joseph Cycenas,own every drop ofwater that falls on my private property, lies on <br /> the surface of my private property,and or lays beneath the surface of my private property, given to me <br /> thru the Homestead Act, which is an Act of Congress,and that BURNETT COUNTY INC., STATE OF <br /> WISCONSIN INC.,or any individual or entity has never purchased the water rights or have paid for <br /> the storage of that water on my private property" <br />
